By accessing or using JobFotos.ai, you agree to be bound by these Terms. If you disagree with any part of these terms, you may not access the Service.

JobFotos.ai provides an AI-powered service that transforms your casual photos into professional headshots suitable for LinkedIn, resumes, business profiles, and other professional uses.

2.1 Free Service

• Unlimited photo generations at no cost
• 400px preview downloads (free, no watermark)
• Free previews stored for 30 days, then automatically deleted
• No account or payment required for free previews

2.2 Paid Service (HD Downloads)

• High-resolution photos (2400px width)
• Professional quality JPEG format
• Photos stored permanently in your account
• Purchase packages: Starter (5 downloads), Pro (15 downloads), Business (50 downloads)

3.1 Age Requirement

You must be at least 18 years old to use this Service. By using JobFotos.ai, you represent and warrant that you are at least 18 years of age.

3.2 Account Registration and Authentication

While account registration is not required for free previews, you must create an account to access premium features. You can create an account using:

• Email and Password: Traditional email/password authentication
• OAuth Social Login: Sign in with Google, Facebook, or LinkedIn
  • One person may not create multiple accounts using different OAuth providers to abuse free credits
  • Accounts with the same email address will be automatically linked
  • You can manage your linked authentication methods in Settings

Account holders can:

• Purchase and download HD photos
• Access your generation history
• Manage your purchased photos
• View payment history and billing information
• Edit your profile (name and profile picture)
• Delete your account and all associated data at any time

3.3 Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized access or security breach.

4.1 Your Responsibilities

You agree to:

• Upload only photos of yourself or photos you have permission to use
• Use the Service for lawful purposes only
• Provide accurate information when creating an account
• Respect intellectual property rights
• Not attempt to manipulate, exploit, or abuse the Service

4.2 Prohibited Uses

You agree NOT to:

• Upload photos of other people without their explicit consent
• Upload photos of minors (under 18 years old)
• Use the Service to create fake identities or impersonate others
• Upload inappropriate, offensive, or illegal content
• Attempt to reverse engineer or copy our AI technology
• Use automated tools to abuse the free generation feature
• Resell or redistribute generated photos as a service
• Violate any applicable laws or regulations

5.1 Pricing

HD download packages are priced as follows:

• Starter Package: 5 downloads - €9.99
• Pro Package: 15 downloads - €19.99
• Team Package: 50 downloads - €39.99

Prices are subject to change. Current pricing will always be displayed before purchase.

5.2 Payment Processing

All payments are processed securely through Stripe. We accept major credit cards. By providing payment information, you represent that you are authorized to use the payment method.

5.3 Credits and Usage

• HD download credits do not expire
• Credits are non-transferable and non-refundable
• One credit = one HD photo download
• You can generate unlimited free previews before deciding to purchase HD downloads

6.1 Digital Products

Due to the nature of our digital service, all sales are final. Once you purchase and download an HD photo, we cannot offer refunds.

6.2 Service Issues

If you experience technical issues or quality problems with your generated photos, please contact our support team within 7 days of purchase. We will work to resolve the issue, which may include:

• Regenerating your photo with adjusted parameters
• Providing technical assistance
• In exceptional cases, issuing credits or refunds at our discretion

6.3 Unused Credits

Purchased credits that have not been used are non-refundable. We encourage you to generate multiple free previews before purchasing HD downloads to ensure satisfaction.

7.1 Your Photos

You retain all ownership rights to the photos you upload and the AI-generated photos created from them. We do not claim any ownership of your content.

7.2 License to Use

By uploading photos to our Service, you grant us a limited license to:

• Process your photos using our AI technology
• Store your photos according to our data retention policy
• Display your generated photos in your account

This license terminates when you delete your photos or account.

7.3 Our Technology

The Service, including all software, AI models, designs, and content (excluding user-generated content), is owned by JobFotos.ai and protected by copyright, trademark, and other intellectual property laws.

7.4 Usage Rights

Photos generated by our Service may be used for:

• Personal and professional purposes (LinkedIn, resumes, business cards, etc.)
• Commercial use in your own business materials
• Social media and online profiles
• Sharing via our integrated social sharing features (WhatsApp, iMessage, X, LinkedIn, Xing, TikTok, WeChat, RedNote)

You may NOT:

• Resell generated photos as stock photography
• Use photos to impersonate others
• Claim the AI-generated photos were created by a human photographer
• Share HD download links or files publicly (use our social sharing feature instead, which uses preview versions)

7.5 Social Sharing and Asset Protection

When you use our social sharing features, please note:

• Preview versions only: All social sharing links use preview (watermarked, 400px) versions, even for purchased HD photos
• HD protection: Your purchased HD photos (2400px) remain private and cannot be shared via public links
• Account features: You can download your purchased HD photos directly to your device for personal use
• Batch operations: You may select multiple photos for bulk deletion or favoriting within your account

Your privacy is important to us. Our collection and use of personal information is described in our Privacy Policy. Key points:

• We never use your photos to train AI models
• Free previews are deleted after 30 days
• Purchased HD photos are stored permanently (unless you delete them)
• Original uploads are deleted immediately after processing

9.1 Availability

We strive to provide reliable service but do not guarantee uninterrupted access. The Service may be temporarily unavailable due to:

• Scheduled maintenance
• Technical issues or outages
• Third-party service disruptions

9.2 Modifications

We reserve the right to modify, suspend, or discontinue any part of the Service at any time, with or without notice. We are not liable for any modification, suspension, or discontinuation of the Service.

10.1 "As Is" Service

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

10.2 AI Accuracy

While we strive for high-quality results, AI-generated photos may not always meet your expectations. We do not guarantee:

• Perfect facial similarity or accuracy
• Specific aesthetic outcomes
• Suitability for all professional contexts

We encourage generating multiple free previews before purchasing HD downloads.

10.3 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, JOBFOTOS.AI SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.

You agree to indemnify, defend, and hold harmless JobFotos.ai and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses arising from:

• Your violation of these Terms
• Your violation of any third-party rights, including intellectual property rights
• Your use of the Service
• Content you upload or generate

12.1 Your Right to Delete

You have the absolute right to delete your account and all associated data at any time. This is a core GDPR compliance feature.

12.2 How to Delete Your Account

1. Sign in to your account
2. Go to Settings → Security tab
3. Scroll to the "Danger Zone" section
4. Click "Delete Account" and confirm

12.3 What We Retain

After account deletion, we retain anonymized payment records for tax and legal compliance (up to 7 years as required by law). These records contain:

• Transaction dates and amounts
• Payment method type (not full card details)
• Package purchased

These anonymized records do NOT contain any personally identifiable information. They cannot be linked back to you.

12.4 Warning: Permanent Action

Account deletion is PERMANENT and CANNOT BE UNDONE. Once deleted:

• You lose access to all your generated photos (including purchased HD photos)
• Unused download credits are forfeited without refund
• You cannot recover your account or data

12.5 OAuth-Specific Deletion

If you signed in using Google, Facebook, or LinkedIn:

• Deleting via Settings: Completely removes your JobFotos.ai account and data
• Revoking OAuth access at provider level: Disconnects the login method but does NOT delete your JobFotos.ai account. You must use our Settings page to fully delete.
• Facebook Data Deletion Callback: We comply with Facebook's data deletion requirements. Visit our Privacy Policy for details.

13.1 Termination by You

You may stop using the Service and delete your account at any time. Unused credits will be forfeited.

13.2 Termination by Us

We reserve the right to suspend or terminate your access to the Service at any time, without notice, for:

• Violation of these Terms
• Fraudulent or illegal activity
• Abuse of the Service
• Any other reason at our sole discretion

13.3 Effect of Termination

Upon termination:

• Your right to use the Service immediately ceases
• Your account and data may be deleted
• Purchased HD photos may become inaccessible
• Unused credits are forfeited without refund

14.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the European Union and the country where JobFotos.ai is registered, without regard to conflict of law principles.

14.2 Dispute Resolution

Any disputes arising from these Terms or your use of the Service shall be resolved through good faith negotiations. If negotiations fail, disputes shall be resolved through binding arbitration or in the courts of competent jurisdiction.

15.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and JobFotos.ai regarding the Service.

15.2 Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

15.3 Waiver

Our failure to enforce any right or provision of these Terms shall not be deemed a waiver of such right or provision.

15.4 Assignment

You may not assign or transfer these Terms without our prior written consent. We may assign or transfer our rights and obligations without restriction.

We reserve the right to modify these Terms at any time. We will notify users of material changes by:

• Updating the "Last updated" date
• Posting a notice on our website
• Sending an email notification (for registered users)

Your continued use of the Service after changes become effective constitutes acceptance of the modified Terms.
